In the contemporary era of the Islamic Revolution, the elite and public demands for transparency have taken on a different sphere of existence, and this social movement, at its onset, has called on Iran’s parliament and the legislative system to exercise this public right. Therefore, through using human sciences and experiences in the models of jurisprudence of the political and social system, it is necessary to explain the scientific frameworks of this important and fundamental strategy in the field of governance. Using descriptive-analytical method, this article, on the one hand, followed the scientific models of sociology of law, the most important interdisciplinary field in the legal and social system, to explain the principles of and the need for transparency in the structure of legislation and its effects on promoting sociability and efficiency. On the other hand, by addressing some of the principles and jurisprudential principles effective in the ruling of this channel of governance, it explained the jurisprudential approaches to this issue. شفافیت یکی از جوان ترین نهادهای مؤثر در حکمرانی کارآمد تلقی می شود که جوهره‌ی تعمیق مردم سالاری و عامل افزایش مشارکت عمومی در ساختار سیاسی کشور است. در دوران معاصر انقلاب اسلامی، مطالبه نخبگانی و عمومی پیرامون شفافیت، سپهر وجودی متفاوتی گرفته و این حرکت اجتماعی در مطلع خود مجلس شورای اسلامی و نظام تقنینی را به استیفای این حق عمومی فراخوانده است. لذا بایسته است تا با استفاده از علوم و تجارب بشری تحت الگوهای فقه نظام سیاسی و اجتماعی به تبیین چارچوب های علمی این راهبرد مهم و اساسی در عرصه‌ی حاکمیت پرداخت. در این مقاله با استفاده از روش توصیفی ـ تحلیلی، از طرفی با استفاده از الگوهای علمیِ جامعه شناسی حقوق، به عنوان مهم ترین حوزه‌ی بین رشته ای در زمینه‌ی نظام حقوقی و اجتماعی، مسئله‌ی مبانی و ضرورت ایجاد شفافیت در ساختار تقنین و آثار آن در ارتقای جامعه پذیری قوانین و کارآمدی آن تبیین می شود؛ از طرف دیگر، با تعریض به برخی از اصول و قواعد فقهی مؤثر در حکم ایجاب این مجرای حکمرانی، رویکردهای فقهی این مسئله مورد بررسی قرار گرفته است. https://marefatefarhangi.nashriyat.ir/sites/marefatefarhangi.nashriyat.ir/files/article-files/6_36.pdf
