This study as a discovery about fact seeks to analyze the true foundations of the originality of society or the originality of the individual in the objective world . Looking at issue from the viewpoint of Islamic jurisprudence which does not not have a long history reflects a different origin ,because in the science of jurisprudence, we will not seek to discover the reality of the originality of the individual and society,but whether it seeks to compilation of jurisprudential conventions and constructions of rejected in it, conjumction as it is what is has been a target for duties or not? Ayatollah Sadr as one of the contemporary intellectual jurists, based on his theory of jurisprudential systematization, has a different view on the originality of social identity in the process of inferring the jurisprudence of the system. This theory can be explored in the field of cultural policy as an important jurisprudential basis. This study investigate this issue in a descriptive-analytical. بحث از اصالت فرد و اجتماع، مسئله ای کهن در قلمرو فلسفه‌ی سیاسی است. این دانش، در مقام کشف از واقع درپی تحلیل بنیادهای حقیقی اصالت اجتماع و یا اصالت فرد در عالم خارج می باشد. نگرش به این مسئله از منظر فقهی که سابقه‌ی چندانی ندارد، خاستگاه متفاوتی را تداعی می نماید؛ زیرا در علم فقه به دنبال کشف از واقعیت اصالت فرد و اجتماع نخواهیم بود، بلکه درپی این پرسش است که آیا در تدوین اعتباریات فقهی و انشائات مطروح در آن، اجتماع بماهو اجتماع مطمح نظر و خطاب تکالیف قرار گرفته است، یا خیر؟ شهید آیت الله صدر، به عنوان یکی از فقیهان روشنفکر معاصر، بر اساس نظریه‌ی نظام سازی فقهی خود، نگاهی متفاوت به اصالت پنداری هویت اجتماعی در فرایند استنباط فقه نظام دارد. این نظریه می تواند در حوزه‌ی سیاست گذاری فرهنگی، به مثابه‌ی یک مبنای مهم فقهی مورد واکاوی قرار گیرد. این نوشتار با روش توصیفی ـ تحلیلی به این موضوع می پردازد. https://marefatefarhangi.nashriyat.ir/sites/marefatefarhangi.nashriyat.ir/files/article-files/3_31.pdf
